AI Tools Propagate Web Accessibility Failures at Scale

WebAIM and AudioEye reports show AI-generated sites carry forward 95.9% failure rates and doubled lawsuits targeting ecommerce.

AI is writing copy, building landing pages, and generating code for digital experiences. The 2026 WebAIM Million report found 95.9% of the top one million website homepages contain detectable accessibility failures, with an average of 56.1 errors per page. Errors rose 10.1% year over year, reversing prior improvement. According to MarTech, the average homepage now holds 1,437 elements, a 22.5% increase in one year.

AI Training Data Replicates Existing Failures

The six most common accessibility failures have ranked highest for seven consecutive years. AI tools trained on existing web content learn these patterns directly. The New York City Bar Association stated in its June 2025 report that AI cannot solve for accessibility if it was never trained to recognize it. Failures such as low-contrast text, missing alt text, and unlabeled form fields remain hidden until users encounter them through screen readers or keyboard navigation.

Lawsuits Double Since 2020

According to MarTech, U.S. digital accessibility lawsuits have doubled since 2020 per AudioEye’s 2026 Web Accessibility Litigation Report. Seventy-eight percent target ecommerce, and 26,253 combined federal and state claims were filed in 2025 alone. Thirty-eight point five percent of sued companies already had an accessibility tool in place. On June 4, 2026, a French court ordered Carrefour to achieve full conformance on carrefour.fr and its app within six months under the European Accessibility Act.

Spending Power at Risk

More than 1.3 billion people globally live with a disability. Together with family and friends they represent over $18 trillion in spending power according to the Return on Disability Group. Seven out of 10 customers with disabilities will leave an inaccessible website, and 83% limit shopping to sites they know work for them. Settlement costs range from $15,000 to $75,000, with legal fees adding $10,000 to $30,000. One retailer case reached $5.15 million after five years.

According to MarTech, marketing teams hold leverage to address these gaps because AI now directly shapes customer-facing experiences.
